Terms of Service

These Terms of Service ("Terms") are an agreement between you and Pinakin Labs ("we", "us") covering your use of our games and apps — including Fun Charades on iOS and Android — and our websites (together, the "Services"). By downloading, installing or using the Services, you agree to these Terms. If you don't agree, please don't use the Services.

1. Who can use the Services

You must be at least 13 years old (or the equivalent minimum age in your country) to use the Services. If you use the Services on behalf of someone under that age — for example, handing the phone to younger family members during a game — you are responsible for their use.

2. Your license to play

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Services on devices you own or control, for your own entertainment. You may not copy, modify, distribute, sell, rent, reverse-engineer or extract the source code of the Services except where the law expressly permits it.

3. Accounts and game services

Parts of the Services (cloud sync, restoring purchases across devices, sharing decks) use an optional sign-in through Google Play Games or Apple's game services. You're responsible for your platform account; we may suspend access that we reasonably believe is fraudulent or abusive. How we handle the associated data is described in our Privacy Policy.

4. Coins, purchases and subscriptions

• Virtual items. Coins, deck unlocks and similar in-game items are licensed to you, not sold. They have no real-world monetary value, cannot be exchanged for cash, and are not transferable outside the game.
• Purchases. In-app purchases are processed by Apple or Google under their terms. Prices may change; purchases are generally non-refundable except as required by law or by the relevant store's refund policy.
• Subscriptions. VIP subscriptions renew automatically until cancelled in your App Store or Google Play account settings. Cancelling stops future renewals; it doesn't refund the current period.
• If we discontinue a game, virtual items in it may become unusable; where a store's policy provides remedies, those apply.

5. Your content (custom decks)

Decks and words you create remain yours. If you sync or share them through the Services, you grant us a worldwide, royalty-free license to host, store, transmit and display that content solely to operate the Services (for example, delivering a shared deck to a friend who enters your code). Don't create or share content that is unlawful, infringing, hateful, sexually explicit involving minors, or that harasses identifiable private individuals. We may remove content and restrict features that violate these Terms.

6. Fair use of the Services

You agree not to: cheat, exploit bugs for gain, interfere with or overload our systems, scrape or harvest data, misrepresent your affiliation with us, or use the Services to violate any law. We may suspend or terminate access for violations.

7. Ads and third-party services

The Services may show ads and include third-party services (app stores, ad networks, analytics) that have their own terms and privacy policies. We are not responsible for third-party content or services, including advertised products.

8. Intellectual property

The Services — including game names, logos, artwork, characters, deck content and software — are owned by Pinakin Labs or its licensors and protected by law. Except for the license in section 2 and your own content in section 5, no rights are granted to you.

9. Disclaimers

The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the Services will be uninterrupted, error-free or always available. Play responsibly — charades gets physical; mind the furniture.

10. Limitation of liability

To the fullest extent permitted by law, Pinakin Labs will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of data, coins or virtual items, arising from your use of the Services. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or INR 2,000. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

11. Termination

You can stop using the Services at any time by uninstalling. We may suspend or terminate the Services or your access to them for violations of these Terms or where required legally; sections that by their nature should survive (5, 8, 9, 10, 13) survive termination.

12. Changes to the Services or these Terms

We may update the Services and these Terms. If we make material changes we'll update the date above and flag the change on this page or in the app; continuing to use the Services after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the courts of India — except where the mandatory consumer law of your country of residence provides otherwise. Nothing in these Terms limits rights you have under mandatory local law, including Apple's and Google's store terms.
